Digital Millennium Copyright Act (DMCA) Policy

Minkly LLC respects the intellectual property rights of others and expects users of Minkly.io to do the same.

In accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512, we respond expeditiously to copyright infringement claims reported to our designated copyright agent.

Counter-Notification

If you believe material you posted on the Site was removed or disabled by mistake or misidentification, you may file a counter-notification with our copyright agent. The counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled, and the location where it appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled by mistake or misidentification.
  4. Your name, address, telephone number, and email address, plus a statement that you consent to the jurisdiction of the appropriate federal district court and will accept service of process from the person who submitted the original DMCA notice or that person's agent.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Minkly LLC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to the Site or terminate the accounts of users who infringe the intellectual property rights of others, whether or not there is repeat infringement.

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Additional Information

We may request additional information before removing allegedly infringing material.

Upon receipt of a valid DMCA notification, we may remove or disable access to the allegedly infringing material and notify the user who posted it.

We may also forward the complaining party's contact information to the user who posted the allegedly infringing material so that they may respond directly to the allegations.
